2015 Construction Contracts Act HotHouse

The Construction Contracts Amendment Act 2015, passed on 20 October, will come into effect progressively from 1 December this year to 31 March 2017.  The Act had a long gestation, beginning with the release of the initial discussion document in November 2010, and will have an even longer reach, extending right across the construction sector.  The practical and financial cost of the changes to industry could be considerable and there is much new to absorb.

In this Hothouse, we will provide:

  • a broad overview of the Act
  • a discussion of the practical effect of making all adjudicator determinations - on rights and obligations as well as payment disputes - enforceable in court
  • an analysis of the implications of expanding the coverage of the Construction Contracts Act 2002 to include design, engineering and quantity surveying work, and
  • details of how the new retentions trust regime will work, including some of the potential fishhooks.

This session will provide you with one CPD hour.
