This paper was first presented at the Personal Property Security Law Conference (Adelaide Law School) in March 2013.
The paper reviews New Zealand’s PPSA experience first by noting some of the practices that have built up in relation to the documentation, registration and enforcement of security interests. Second, it considers the nature and scale of the litigation that has led to New Zealand’s court decisions. Lastly it reviews the major issues that have arisen in the New Zealand cases, by reference to a number of major themes or issues.
